southern MN | In my area of the state ditches were created by the govt way back in the 1920s already. Can’t think of any private ditches. I suppose a few waterways some have on their own land a few 100 feet.
Probably different that far north, but I would check out if there are any old records of the ditch….
The county oversees the ditches, but maintainence fees are collected from landowners, and the ditches are their own thing, not really owned or controlled by the county. Administered by. If enough folk along the ditch petition to clean it, it gets reviewed and cleaned out, assessed to the landowners.
In the last decade the state has become more interested in ditches, and you might be able to roll that waterway into a more uniformly fee and county maintained setup. The bad is you give up some control, the good is the county has an easier time dealing with don’t and wetlands type issues, and the ditch can get properly cleaned out when needed without endless bottlenecks like you have.
